🚫 PROPRIETARY SOFTWARE AGREEMENT

CRITICAL NOTICE: LumaMH is 100% proprietary software owned exclusively by LUMA Mental Health Platform. These Terms of Service constitute a restrictive license agreement for authorized use only.

By accessing this platform, you acknowledge that all rights, title, and interest remain exclusively with LUMA. No ownership rights are transferred to users under any circumstances.

1. Acceptance of Terms & License Grant

By accessing LumaMH, you agree to these Terms of Service and are granted a limited, non-exclusive, non-transferable, revocable license to use our proprietary platform solely for personal mental health support. If you disagree with any terms, you must immediately cease all use.

License Restrictions:

• NO modification, adaptation, or derivative works
• NO reverse engineering, decompiling, or disassembly
• NO redistribution, sublicensing, or commercial use
• NO data extraction, scraping, or automated access
• License terminates immediately upon violation

2. Proprietary Service Description

LumaMH provides proprietary AI-powered mental health support through our exclusive platform:

• Proprietary AI therapy algorithms and emotional support systems
• Exclusive mood tracking and wellness analytics technology
• Proprietary personalized mental health guidance systems
• Exclusive crisis detection and intervention protocols

All algorithms, AI models, data processing methods, user interfaces, and therapeutic approaches are proprietary trade secrets of LUMA Mental Health Platform. Any attempt to replicate, reverse engineer, or create competing solutions based on our platform is strictly prohibited and legally actionable.

Prohibited Uses

You may not use our service to:

✗ Generate harmful or inappropriate content
✗ Attempt to reverse engineer our AI systems
✗ Use the service for commercial purposes without permission

6. Intellectual Property & Proprietary Rights

100% OWNERSHIP: LumaMH and ALL associated content, features, functionality, algorithms, AI models, data structures, user interfaces, therapeutic methodologies, and intellectual property are owned EXCLUSIVELY by LUMA Mental Health Platform.

PROTECTED BY: Copyright, trademark, trade secret, patent, and other intellectual property laws. Unauthorized use, reproduction, or distribution is a criminal offense and civil violation.

7. Termination & License Revocation

Immediate Termination Triggers:

• Any violation of proprietary rights or license restrictions
• Attempted reverse engineering or competitive analysis
• Unauthorized data extraction or platform replication
• Breach of confidentiality or trade secret protection
• Non-payment of subscription fees (premium users)

Upon termination: All access is immediately revoked, data may be retained per privacy policy, and legal remedies may be pursued for violations.

Limitation of Liability

To the maximum extent permitted by law, Luma AI Therapist shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the app. Continued use of the service after changes constitutes acceptance of the new terms.

8. Governing Law & Dispute Resolution

Governing Law: These Terms are governed by the laws of New Brunswick, Canada, without regard to conflict of law principles.

Jurisdiction: Any disputes shall be resolved exclusively in the courts of New Brunswick, Canada.

Intellectual Property Violations: LUMA reserves the right to pursue legal action in any jurisdiction where violations occur.

9. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and LUMA Mental Health Platform.

⚖️ LEGAL ENFORCEMENT NOTICE

LUMA Mental Health Platform actively monitors for violations of these Terms and will pursue all available legal remedies against unauthorized use, including but not limited to injunctive relief, monetary damages, and attorney fees. We maintain comprehensive logging and tracking systems for evidence collection.
